ENFORCEMENT AGAINST MOVABLE PROPERTY

Enforcement against movable propertyis the form of enforcement by which monetary claims against the debtor are satisfied through the sale of the debtor’s movable property.

The enforcement procedure consists of the following steps:

  • Obtaining the enforcement order – Article 665 of the Code of Civil Procedure
  • Identification and seizure of assets – Article 730 of the Code of Civil Procedure
  • Sale of the assets at auction – Article 752 of the Code of Civil Procedure
  • Distribution of the proceeds – Article 863 of the Code of Civil Procedure

Each stage, in turn, involves specific enforcement procedures.

Enforcement against movable propertyis carried out after a notice has been sent to the debtor, who has one day to make voluntary payment.
