Enforcement against real property is the procedure by which monetary claims against the debtor are satisfied through the sale of the debtor’s real property.
Enforcement against real property is preceded by service on the debtor of the order authorizing enforcement, informing the debtor that the amount due to the creditor under the enforceable title must be paid within 15 days of receiving the order.
The enforcement procedure consists of the following steps:
- Obtaining the enforcement order – Article 819 of the Code of Civil Procedure
- Sale of the real property at auction – Article 834 of the Code of Civil Procedure
- Issuance of the deed of adjudication – Article 852 of the Code of Civil Procedure
- Distribution of the proceeds – Article 863 of the Code of Civil Procedure
