Enforcement of Unfair Terms

Ulman Bogdan Judicial Enforcement Office from Bucharest enforces enforcement of court judgments concerning declaratory proceedings based on Government Ordinance No. 50/2010 and Law No. 193/2000, under which certain contractual terms in loan and lease agreements were declared unfair.

Law No. 193/2000 on unfair terms in contracts concluded between professionals and consumers, republished in 2012, provides in Article 6: “Unfair terms contained in a contract and identified either directly or by bodies authorised by law shall have no effect on the consumer, and the contract shall continue to be performed, with the consumer’s consent, only if it can continue after those terms have been removed.”

After removing such terms from loan, credit or leasing agreements under Article 6, the court must rule on compensation for the damage caused by their application.

Court judgments ordering debtors (credit or leasing institutions) to refund amounts to creditors (natural or legal persons) may be enforced by Ulman Bogdan Judicial Enforcement Office.

The amounts thus obtained are transferred by the Ulman Bogdan Judicial Enforcement Office directly to your account or may be withdrawn in cash directly from the bank, at no cost to you (fees, commissions, etc.).
