ESTABLISHMENT OF FACTS

Establishment of facts is the procedure whereby, at the creditor’s request, the judicial enforcement officer records on site a factual situation that may cease to exist or change.

Establishment of facts under the conditions provided for in Article 364 of the Code of Civil Procedure

The factual situation is recorded by the judicial enforcement officer in a written report, which is submitted to the court and, if the person against whom the finding was made was not present, a copy is provided to that person; the report has the evidentiary value of an authentic instrument.
