Drawing up, in accordance with the law, protests for non-payment of bills of exchange, promissory notes and cheques
Protest for non-payment of a bill of exchange, promissory note or cheque, as applicable, payable on a fixed date, at a specified period after issue or at sight, must be drawn up on one of the two working days following the due date.
If the instrument is payable at sight, the protest must be drawn up within the period allowed for presentment for payment, namely within one year of its date.
The protest for non-payment is drawn up by the judicial enforcement officer at the address stated in the bill of exchange, promissory note or cheque. If no address is stated, the protest shall be drawn up at the address of the drawee or of the person designated in the bill to pay on the drawee’s behalf, at the address of the acceptor for honour or of the person designated in the bill to pay on that person’s behalf, or at the address of the referee in case of need.
If the address of those persons cannot be found, the protest shall be drawn up at the court within whose territorial jurisdiction the place of payment indicated in the bill of exchange, promissory note or cheque, as applicable, is situated.
